Tenant not leaving at end of lease
Hey everyone... I am a landlord in PA . Can someone please help me? I own a duplex and rent out the top floor.( I live on the bottom)I have problem tenants. They have breached the lease many times and I have overlooked it. It has now gotten to the point where I can't take it any longer. I have never wrote them a written warning but I have verbally warned them. Some of the things are... They were smoking pot in the building... they have borrowed a ladder off the neighbor to climb on my roof because they were locked out... They had a cat... they smoke in my apartment... they took down the smoke alarms... they are constantly fighting very loud... all of this and they also have a 12 month baby living there. These things that I mentioned are a breach of the lease. Also they are constantly late on rent.(although I don't have any record because they were paying cash and stupid me didn't think to give them a receipt.) The lease is up on April 30th, 2008. What happens if they don't leave? What do I have to do to get them out? I didn't want to pursue eviction because there are only a couple months left...

If you intend to just let the lease run out, be sure to give them WRITTEN notice at least 30 days before the expiration that you wish them to move at the end of the lease because it will not be renewed, nor will it go to a month to month tenancy. If they refuse to leave at the end of the lease, then you will have no choice but to evict them.

I can say this, you really don't need to be a landlord or you don't need to do it on a written lease, since you don't enforce them anyway.
And none of the things you say has happened ever has happened, since you did not write up and give themm warning for it. You give them a notice that you are not going to renew the lease and that they will be expected to move at the end of the lease. Then of course don't expect them to pay you the last months rent, and expect them to have torn up some things when they move. And of course they won't most likley move on your noice but you will have to end up evicting them for not moving, so they will get to stay another month or so beofre you decide to evict. I am sounding hard because renting and being a landlord is a business, you have to run I like a business. |
