    Probation violation
    My husband has been sober for 2 years now and is a substance abuse counselor. Last night he was arrested on a warrant for violation of probation. This happened in NJ. At the time he was attending proabtion in NJ, but when they told him they were transferring his case to NY where we live they told him he would receive a letter in the mail and he never did. After several phone attempts with no response my husband gave up. Soon after he attended rehab for a year and worked his way to becoming a drug counselor. I don't know what to do or what to expect. I can't afford any expensive legal fees. What do you think he will be facing (or the maximum). Thanks

    Basically your husband screwed up not pursing the probation department about his probation transfer. The lame excuse of he never got a letter from them tells me he was not that serious about fulfilling his probation obligation. Unfortunately at this part of the movie he will probably have to do his jail time as a judge will not buy his excuse of he never got a letter and several phone attempts. Had he sent THEM a letter asking them where their letter is, now that's a different story altogether had he kept a copy of that letter.

    If you cannot afford an attorney, he can ask for a public defender at the time of his probation violation hearing and he'll get his chance to speak to an attorney then.

    I use to live in WV and was court ordered to pay child support. I moved to FL. And was caught with an empty bag of controlled substance. I was placed on 18months probation and was given 50 hours of community service and 8 weeks drug classes. I have done my classes and community services. I was arrested for non payment of child support and was taken back to WV. My probation officer said not to worry that after I get everything taken care of there to come back to FL. And finish out my probation. When I was arrested she came to my house with the cop that arrested me. She told me I won't get into any trouble because shild support happened before I got on probation down here. While I was in WV she violated my probation and had a warrant out for my arrest. I was just wondering what can I do, I had a lot of people tell me that she can't do that because the child support happened before I got into trouble here. I have had people tell me different things, I don't know what to do and I have a court date on the 18th of Jan. If you could give me some advise, I would appreciate it because I don't know what is going to happen to me. My probation is done in April.
