    Received Summons from Capital One For credit card debt
    I received a summons from an attorney saying I must "appear" and that to " appear" I must file a legal paper called a "motion" Or answer. Must be given to the court clerk or administrator within 30 days along with the required filing fee. There is no case number on the Summons. Is the 30 days from the time I received it or the date it was signed by the attorney? The amount is $ 9030.81 plus interestat the rate of 28.100%.
    I tried making the minimum payments and each time they would tack on another overlimit fee or late fee and I just gave up. I went with a company called privatedebt solutions, to negotiate the debt down, but obviously that didn't happen. There is no way I can pay this and if they get the judgement and garnish my check I'll lose my job. Is there anything I can do at this point? Boletta Fretheim

    Go to the court ask them to look it up by name on the summons. You do not have to pay a filing fee, they do. What ever you do don't lose that summons, it is evidence of harassment and possibly false statements. Never speak to the attorney on the phone, nothing but in writing.
