    Summons for credit card debt
    I received a summons for a credit card debt for a credit card my wife took out in my name a few years ago it for 3000 and some odd dollars she never made a payment on it when she tried to about ayear ago they refused it.I am on social security and we have had financial problems for years we filed bankruptcy about 5 years ago and she has always took care of the bills or so I thought. I have to respond within 20 days what do I do.

    When you filed bankrupty was that debt inclued in your bankruptcy petition? Did you know she took out the cc in your name?

    This credit card was taken out after the bankruptcy.I did know she got the card I used it as well.I just don't know how to respond. I am afraid they will put me in jail.I am willing to make payments on it. Any advice would be helpful

    Hello sid55

    You will not go to jail. Social security can not be garnshed, but if they get a default judgement they may try to attach your bank accounts and then you will have to prove the funds are from social security. Does your wife work? Does her check go direct deposit?

    Hello,Slowandeasy Thanks for responding yes my wife does work and it is direct deposit I hope they don't do that because we are really struggling now as far as my social security I have been disabled with a mental disorder since 1995 so that won't be hard for me to prove.Please write back if you can
