    What are the rights of the father if not married or living with mother?

    Paternal rights are established by the state government where the baby is. Where I live, the father can file a petition to legitimate his child; the court will consider rights of custody, visitation, and child support.

    The father has the same rights as any father regardless of the marital status with the mother. The only difference is he may have to prove paternity to exercise those rights.
