    Bad debt lawsuit
    I have a 25thousand bad debt lawsuit from a surgery I had (thought my insurance should cover) now the creditor is calling my husband and my employer for wage garnishment, we live pay check to pay check Really. How do I get them to not do this or at least wait until we find some help (where to find help) to see if my Insurance should have paid this?

    You do not mention being served with a Summons/Complaint/Judgment. The creditor cannot garnishee without a Judgment - so I don't know what the phone calls are for other than to harass. Tell them to stop calling and send them a certified letter in that regard. If there is no Judgment and the creditor is calling your husband's employer the creditor is in violation of Federal Law.

    And if you think your insurance should have paid it and did not you have to follow the insurance company's procedure to appeal non-payment.

    If they already have a law suit, ( first they can not legally call your husband, and they can not call your employer) if they have a law suit and have won the case, they merely file a motion in court and serve your work place.

    I don't know why they are calling anyone if they already have a law suit won against you?

    But you need to be suing your insurance company if they have not paid at this point. And what help are you thinking of finding?? What is there to wait on. If you can not work out a payment plan they will agree to, they will garnish your pay.
