    I received a letter from a messenger today stating that I am beind sued by mbna over dedbt that was at least 6 yrs old. I was told I needed to respond to the justice of the peace by 10 days. I reside in Texas what do I need to do its scary

    Just reply the way they want you to. Send a registered letter stating your case, asking for documentation of the debt and wait till you hear from them. Get your ducks in order because you have probably gone through the statute of limitations as it never goes over 6 years, so they can come after you for what you owe. Credit cards are not free and you should never charge more then you can afford and pay off month to month. Who do you think pays off the money you charge each month ?

    Yes the SOL is far less than 6 years, so there must have been some payment, some promise of payment or something that has it sooner, or of course the letter is just a lie to get you to pay something, or promise to pay to start the SOL all over again,

    So you need to answer it, and show how you don't owe them the money, how it is over the SOL or say show you alrady paid it.

    DO NOTHING. You are reaching the statute of limitations. If you indicate that you will pay in any way the clock will start over again. I repeat DO NOTHING unless you intend to pay.

    They do have to defend the law suit, deny owing it, demand proof of debt, but if you do nothing, they will get a judgement from the court against you.
