    Smoking in a motor vehicle LAW CHILDREN
    In what states is it illeagal to smoke cigarettes with children in a motor vehicle. What about having the windows rolled down. Is this a potential risk? Thanks:confused:

    NO smoking in cars even with windows rolled down and some states are banning foster parents from smoking in their own homes. It is also going to be against the law to smoke in any home/apartment that is attached to somebody else's even if no kids are involved.
    Vermont, Arkansas and Louisana have the no smoking in cars with kids.
    Texas and California are set to ban smoking in cars by the end of the year.
    Maryland and Maine are in the process and the other states are sure to follow.

    I do not smoke but I am against them passing laws like this because where does it stop.
    Next it will be you get a fine if you take your overweight kid in a fast food restaurant.
    Where will they draw the line?
    I heard they want to make you get a permit every time you want to Bar B Que in your own backyard.

    Ashes flying everywhere, smoke still gets into the back seat, the nicotine seeps into the fabric of the car's interior and stays there. There is a reason why a smoker's car has a much lower resale value. It's like holding the kids hostage - they have no say in the air they breathe in the car.

    Arkansas,Louisiana,Maine Illegal with anyone under 18-Pending N.Y. and N.J.. Are non-smoking with children in the car more invasive than driving with cell phines or eating while driving? Thanks Dan

    "invasive"? The only invasive one is the smoking. Cell phone laws are forthcoming in many places. I see where your argument is going, it seems you're trying to justify the smoking, is that correct?

    Right now if you are on a cell phone and in an accident you are automatically given the majority of the blame even if it was clearly 100% the other persons fault. They will eventually ban that too. I do see too many people that it does affect their driving because they pay more attention to the call than the road.

    I agree with you to some point on this. The no-smoking in the car thing I think is overboard. However, the ban against foster parents smoking in the home, I agree. Children are placed in a foster home with the expectations that they will be provided the safest of care and environment. So many kids have different allergies that if a child with asthma or something like that was placed in a smokers home, they'd still be affected, even if the foster parents temporarily stopped smoking in the home. They are looking after someone else's children... and no not always because the children's parents abused them... they should not be allowed to smoke around them. This is my opinion.

    I view a foster home no different than a daycare in this aspect... I wouldn't send my children to a daycare where the providers smoked... why should other's kids be sent to a foster home where they can smoke.

    Again, only my opinion.
