    Probate & Executers
I have a mess on my hands that should have never even happened. My grandparents set up a will 35yr leaving every thing to be split equally, three ways between my father and my two aunts. In 2000 my grandmother passed away and shortly right after that my aunts started fighting over money. To sum it up aunt1 claims aunt2 barrowed 30K from my grandparents and never paid it back (aunt2 said she did).

My family has owned this property in California for a 100yrs since 1907. In 2002 my aunt1 told my grandfather he should sell some of his property because he could use the money so they sold 700 Acers. Aunt1 handled the sale and let the individual make monthly payment to my grandfather. In 2004 Aunt1 took my grandfather to an attorney and had the original 35yr old will changed with only her name on the sold property (I just found out 8weeks ago). I think she did this because she didn’t want her sister to get any thing else because she thinks she has taken close to 70K out of my grandmothers accounts. In July of 2006 my grandfather passed away and 2 weeks later aunt2 surfaced after being silent for a few years to let every one know she wants to sell the rest of the property (about 100acers).

I have since gone to court in July 2007 to stop the process of assigning an Executer (who would be aunt1) I don’t know who I can trust, they have both said they would not screw my dad, but they are out for blood on each other. I now have to go back to court on Aug 9th; I have submitted a pleading paper on my reasons. All my father wants is this to be split three ways including the payment each month from the other property and move on. We no longer have a family after 100yrs I guess that’s greed for you.

I have thought about getting a forensic accountant to look at the whole picture and to see if I can find out who is lying but I'm not sure if it’s worth it.
