    Prorated rent
    We are on a month to month lease in California. My husband received orders from the military to move on July 20, so we gave notice on June 19. I paid rent for the 20 days we would be living here in July and our landlord went ballistic, insisting that we pay him the full months rent because we're on a "month to month" lease. We've been renting for decades and this has never been our experience. Anyone know the law for certain??

    Hello gina:

    If you pay your rent on the 1st. you need to give your 30 day notice on the 1st. You didn't even give him 30 days. Of course he doesn't like it.

    The general rule on a month to month lease is that you have to give one FULL rental period as notice. That means the month of July so you would owe that whole month. However, there may be special accommodations in the law for military personnel. I suggest you check the CA laws, there is a link to them at the top of this forum.
