Hi,
I'm an unmarried and have a daughter that will be 10 soon and her father was in jail several times prior to being sentence from 1999 to 2006 for dealing drugs. When he got out of jail he went back to dealing drugs again. We still have the same last name because we were married and divorced back in 1998. He had not acknowledge her from birth and when the hospital asked for the name of the father, I gave the information and they assumed we were married and was not. When I went to court the first time after she was born he did not show up and the judge ordered shild support without ordering a paternity test, I guess assuming that we were married because our last names were the same. She was two at the time he went to jail for the dates listed above. When he was released in June of 2006, he came to meet her and in August of 2006 I moved out of state. During a few months that did not bond with each other and I returned back to the same state he in and he has only seen her a few times. Now he wants visitation rights to be scheduled and my daughter feels that she doesn't know him and doesn't feel comfortable around him, there does not want the visitation with him. Because of the frequent conversations that we have had, I feel that he would not be a good role model for her and would like his parenting privileges revoked for good. Please advise

Well of course you can ask for a DNA test to prove he is the father if there is a doubt. ( the birth certificate is not a real issue, the issue is, IS HE or IS HE NOT the father) So if there is a chance someone else is the father you can ask the court for a DNA test.
But it is very likely that if he is the father, and he wants to visit he will get some level of visit award by the court. You can fight it, so go and hire an attorney you will need one. You can also ask for supervised visits if there is a concern ( the fact he has had little to do with child, and he has a criminal record, will help in getting that.

Hello pooh:
If you were married to him in '98 and he was sentenced for dealing in '99, you were part and parcel of it, weren't you? It's only now, when you don't want him to see his child, do you snivel about him and his drugs.
Don't tell me you didn't know about it then and don't tell me you didn't do drugs with him. Who do you think you're trying to kid??

We were divorced in 1989 not 1998. I did a typo error on the date. We separated in 1986.
