Tenant at will
I moved into my apartment 3 years ago and the landlord never renewed my lease on the original lease it did say no pets, But my stepsons counselor said it would be good for him to have a kitten to make him feel better cause his mom hasn't been in his life for almost 2 years now to to her issues. So out landlord saw that cat and told us to get rid of it he didn't want and explanation he said it was on our lease and to get rid of it. What rights do I have since I am tenant at will and he never renewed out lease considering we have asked. Please help I don't want to get rid of my cat. I explained to him that she doesn't scratch anything like walls or carpers we are on top of her everyday and she is a clean cat but he didn't want to hear anything. What can I do. I can't let her go. :(

You shouldn't have taken a cat into the apartment when the landlord said, no pets. It doesn't matter if he didn't renew the lease, you are there and you must abide by his rules.

If you don't have a lease he can give you notice to vacate at any time. With or without the cat.
Find a new place that welcomes your furry family member.

I didn't want to take her in, but I felt bad for my stepson which is 5. We figured this would fill his void on not seeing his mom due to her ISSUES. We are trying to find her a home I just don't want to throw her in the streets. I wish they would give us a little time to find her a home.

If you don't find her a home you will have to take her to a shelter.

Tenant at will, I think you mean you have become a month-to-month tenant. You or he can give a 30 day notice to vacate but he is within his rights. I have regreted every time I allowed someone to have a cat in my units. Even great cats will eventually urinate somewhere on the carpet. Male cat urine is nearly impossible to remove and it gets into the pad. Maybe you can offer the landlord a sizeable increased security deposite because I'm sure he's afraid to be left holding the bag.

I understand completely! I was just trying to make my stepson happy cause he has been depressed and I know that shouldn't be an excuse. We are trying to find her a home if not we will put her in a shelter to respect out landlords. I just hope they don't hold this against us cause we are very good tenants pay the rent on time. Fix things if they can be fixable. I just don't want them to throw us out because of this once incident where we got the kitten.

ibad, you never know how people will react. I am sure if he knows you are respecting his wishes by getting rid of the cat everything will be okay. Just make him realize that is what you are doing. Good luck.
