    Adding my domestic partner to the deed of my condo
    I want to add my domestic partner of 35 years to the deed of a condo I own in Towson, Maryland (Baltimore County). There is no mortgage and there are no liens on the property - I own it outright. How much should it cost to rewrite my deed and file it with Baltimore County? Also, I understand adding the name of one's domestic partner does not result in a tax liability, is that correct (Article 12-108 Annotated Code)? Can you itemize the total amount of fees I will have to pay to accomplish this? Thank you.

    You apparently misunderstand this forum. You cannot get someone here who you can pay to perform this service; for that you should contact an attorney in your state.

    At the same time, the lawyer should be able to answer your question about Article 12-108. The transaction is potentially taxable under the federal gift tax, assuming it exceeds the annual exclusion amount.

    You can get this information very easily by contacting the Recorder of Deeds for Baltimore County. Baltimore County Recorder Information Maryland | Deeds.com That page lists the fees. Since you are essentially selling him a half share in the property, both the state and county Transfer taxes may be applicable. As AK said, since the federal government does not recognize domestic partnerships, they may assess a gift tax. I would strongly suggest contacting an attorney or local CPA to determine what you will have to pay.

    You would hire an attorney or a title company, to write up the new paper work. Depending on their fees, some charge more than others.

    There are filing fees at the courthouse to pay.

    As noted, the tax issue will be at the Federal level,
    You are best, to call and set an appointment with a real estate attorney locally.
