Also, I understand adding the name of one's domestic partner does not result in a tax liability, is that correct (Article 12-108 Annotated Code)? At the same time, the lawyer should be able to answer your question about Article 12-108. The transaction is potentially taxable under the federal gift tax, assuming it exceeds the annual exclusion amount.

Since you are essentially selling him a half share in the property, both the state and county Transfer taxes may be applicable. As AK said, since the federal government does not recognize domestic partnerships, they may assess a gift tax. I would strongly suggest contacting an attorney or local CPA to determine what you will have to pay.
