    Do I need to file Form 8889 ?
    Hi,
    I have already submitted 1040NR (single) and other respective forms to IRS.
    I haven't contributed anything to my HSA account. All the contributions were from my employer only. Do I still need to report it through Form 8889? Anyway since I didn't contribute I can't deduct it right?

    If at all this form is mandatory how can I add this to my filing. As I said I have already submitted my other forms. Kindly let me know whether it is required or not.

    You need to amend the return and add Form 8889, because the HSA contributions, even if made by your employer, MUST be accounted for.

    Thanks Sir/Madam.Could you please tell me the forms that I need to submit now.Should I have to resubmit 1040NR? This Form 8889 is not going to affect my taxable income/tax or refund right ?What are the forms I should submit for this amendment? Kindly guide me.Thanks.

    You just need to submit Form 1040X and attach the Form 8889.

    There should be NO change to the tax calculations.

    (FYI: My case: Non-Resident alien submitted 1040NR (single) without Form 8889. So wants to amend with 1040X)Thanks for the info.I read the instructions of 1040X and here is my understanding (on reading the instructions under Resident/Non-Resident aliens)Kindly correct me if I am wrong. 1. I am using 1040X to amend my 1040NR (filled for 2013) 2. In form 1040X I need to Enter your name, address, and social security number (SSN) or IRS individual taxpayer identification number (ITIN) on the front of Form 1040X. 3. I don't need to enter any other information on page 1. Also nothing on Parts I or II on page 2 of Form 1040X. 4. In Part III the reason why you are filing Form 1040X. I can mention 'Adding Form8889 - HSA' 5. I have to complete a new Form 1040NR and Form 3903 (same as previously sent). 6. Across the top of the new or corrected return, I have to mention "Amended.” Should I do write 'Amended' on top of my W-2s and 1099-Div as well ? 7. Fill form 8889 Should I do write 'Amended' on top of this form as well ? 8. So I need to mail these forms 1. Form-1040X 2. Form-1040NR (with amended written on top) 3. Form 3903 (with amended written on top) 4. Form 8889 5. Copies of W-2s and 1099-Div Kindly review this and let me know if I have to add anything along with this.

    Juts put AMENDED on the Form 1040NR. Everything else is okay.
