    Prevent removal of mobile home
    My sister is in a nursing home in Alabama. We have property lots ; her lot is behind my lot. When she bought a mobile home, I allowed her to put the her mobile home on my land so that she faced the street she wanted to be on. When the state forced her into a nursing home, they (the state) began taking all her property. They now want to take the mobile home but my sister wants to keep it in case she recovers and can come home. How can I protect her mobile home since it is on my land. The financial conservator does not realize it is on my property.

    The fact that it is on your land doesn't really matter. They are using her property to pay for her expenses. Is the mobile home in her name? If so, that is why they are going after it. If it is in your name only then they don't have a claim to it. But it can not be switched to you now that she is already in the nursing home. You may be able to buy it from her for market value and those funds would go to pay for her expenses (that is the reason the conservator is looking at taking the home). But if you were the one to buy it you would then keep the home. If she thinks that she may need to use it again then she needs to talk to the nursing home about that. If she has medicaid, and they are the one's taking the property not the nursing home, then she needs to talk to her case worker. If she has you listed as an authorized representative you may also be able to talk with them.

    You said that the state forced her into a nursing home. That's why I was taking a guess that medicaid might be paying for the nursing home. If that is the case they try to recover the expenses anyway they can. However, being her home, she may be able to have them just hold the rights to it after she passes in case she does go back to living in it.

    How long has she been in the nursing home and how much is her rent to you for the land it is on ?

    The fair market value of the MH on her lot. In other words, offer to pay them the value less the cost of moving it. It is important that they understand that if they want the MH they will have to pay to move it.
