First offense for theft by taking 5,000 in Georgia
Accused of taking 5,000 in cash 3 slips at work. I was intentionally taking anything and she allows us to credit things as employers. I was told I would be charged with taking 5,000. I have no criminal history ever in my life. Do you think I will do time behind this and can I go under the first offenders act.

Have you paid everything back yet? Or are they going to have to take it out of your hide?
That actually does matter when it goes in front of a judge.

So you were charged with felony embezzlement? It kind of sounds like you haven't been arrested or charged yet though?
$5k is quite the bit of change. I've seen people get jail time for less along with a plea deal.
If you haven't been arrested; don't talk to police and get yourself an attorney immediately.

I went to jail that same day and bailed out that night.. I'm just waiting for court date and I'm still in preindictment status.. I have no criminal record at all. Even if I didn't do it and plead not guilty and they same I am guilty can I use my first offender act?

You mqybe, might, could get out of jail time, but you will have to make restitution, pay any fines, take any classes or do any community service they might have you do.

I don't care what it is to do, even if they feel I'm guilty. I just want to be home with my daughter that is 6

Again, $5k isn't small change. I think with a lawyer you might be able to avoid a jail sentence especially with no priors. If you can pay restitution before court, do so immediately. Can you tell us the exact crime you're being charged with? Misdemeanor? Felony?
If you can't afford a lawyer, call the court house and get a PD immediately. It might be hard to get in touch with them, but it'll only give them more time to review your case.
Georgia's first offenders act doesn't guarantee you won't face a jail sentence. However, it will undo your conviction after serving the terms of your sentence. You do qualify, but you must remember that you need to ask the judge to be sentenced under the act.

This will depend on where you are at, in many places a felony can not be done under a first offender program. They will be looking if you have paid back all of the money taken. And other factors. Because of the amount, anything is possible. Most likely you are looking at probation, and fines.

No money was taking.. I'm accused of theft by taking felony for placing cash 3 slips in the machine and the manager say I stole them, but at this store were I worked she would allow us to credit merchandise and customer's as well, she would just take it out of the check at the end of the week.

My court date is November 15 and I'm scared.. I didn't do the crime, but willing to plead whatever to stay out of jail to keep my daughter and see about my mother.. the owner of this store is the thief really and stealing from people and doing food stamp fraud
