    Guest asked to leave your house
    So I let my son in laws mother stay w me. She pays nothing,not even for her food. She brought her nasty dogs and just has to go.. I told her she could stay a couple of months max. she has made slim to none attempts at securing a job and is driving me insane... My landlord does not even know she is there and would have a fit about the nasty little dogs.. so what do I do? I live in Tn

    Of course, you can be evicted if this is against the terms of your rental agreement.

    If she has been there several months, she is no longer a guest but a resident. That means she is protected by the laws governing tenants.

    Give her 30 days written notice to vacate. If she doesn't leave, then you will have to go to court to evict her.

    Agreed, you are now her "landlord" and have to give her notice,
    Also have dogs been there entire time ? Are you allowed dogs under your lease ?

    Does her being there violate your lease in any way

    All the above assumes that this "guest" considers your apartment to be her home - i.e. she receives mail there, has her own key to the apartment, etc. If so - then she is your tenant and to force her out you must follow legal procedures.

    However - have you talked to her and or your son-in-law about the situation? Is she aware that you want her out? Perhaps a good meeting of the minds will resolve this without going through legal proceedings - for example perhaps she can move in with her son and your daughter instead of living with you. Or you could let her know that the dogs have to go because the landlord is complaining - and that may be enough for her to go as well.

    I would not want to debate "tenant" vs "guest" if I wanted someone out and they didn't want to go. I would follow the law, send the notice, evict the person if she doesn't leave.

    Yes, if discussing it works, then that's a better, faster plan, but if it doesn't I wouldn't want to move someone out, assuming she's a guest, and find out that she, in fact, is by law a tenant.

    I learned the hard way - no key, no mail, still considered to be a legal resident.

    I agree the first step is to ask when she is moving. If she doesn't give a time, follow up with a notice to vacate.
