    At wits end
    I have an x-girlfriend who's living with me and will not move out.We've broken up and I would like to move on with my life but she says she has legal rights to stay and live at my house.She doesn't pay any rent or any bills,even though she has in the pass but not now.The house is in my name,she still gets mail here and we stay in Illinois.Can somebody please help me

    She's definitely blackmailing you and you have done a mistake of not setting rules and boundaries before getting into a live in relationship. May be she will leave you if she finds another boyfriend. You should consult a lawyer or ask lawguru website you problem. Plus you also have right as she has. You haven't forced her or pressurize her. I think she need to understand that you guys are not married and you guys are through.

    smkanand, this is an easily answered legal question, and doesn't need a law website.

    You need to evict her according to the laws of IL. Give her a notice to quit (it would help to have a witness, or send it certified mail). Then proceed with a formal eviction through your local county court, and if it goes to the end, a sheriff removes her. This will take at least a month.

    joypulv is right, but this will take some time. You should pay the extra fee for the sheriff or process server to deliver the eviction notice! Next be prepared to pay to have her stuff moved-out of your property and stored. In my area, a bonded mover is required, the secured storage facility has to keep the stuff at least 90 days, and then has to advertise in the paper that the stuff is being disposed of. Lots of bucks! So try and help her get rid of stuff first! To get her out where I live plan on 2 1/2 months. Sorrry. See if there is a tenant resource center or advocate in your area. Contact them as if you are getting evicted and see what crap she might try to get away with. Its amazing the crap they can try. Better to be prepared.
