    Ex boyfriend signed declaration of paternity 7 years ago and now wants DNA test
    My ex boyfriend and I had a long on/off again relationship. He signed the declaration knowing our daughter may not be his. I was with someone else while we broke up. The other man wanted a DNA test to know and my ex boyfriend Said no he wanted to raise her either way she was his. Fast forward 7 years and he is claiming that I just recently told him he may not be the father and served me with court papers he wants a DNA test and to pay 0 child support! Is the court going to believe I misled him for 7 years? I would never do that and my daughter loves this man as her father and I can't believe he wants to cut her off after 7 years. He has been in and out of her life because our relationship was a roller coaster and recently I found out he is gay and that's why he has pulled so many disappearing acts on us. Anyway he knows I know he's gay and he can't use us as a cover anymore and he wants to cut my daughter off. But we have a two year old together also and he wants her half the time. So sad for my daughter, any advice??

    He has been in and out of her life, so why do you find this hard to believe. Hard to believe would be if he was there every week and always there for her.

    It will depend on where you live, as to if the court will even listen to the case. Or if you present the case good. The fact he is not the father will not help your case. Remember your defense in this is that you and he agreed to falsify and commit perjury on legal documents of the child birth. ** not really great for you

    Any question on law needs to include your general local as laws vary by area.

    Some areas limit the window of time a parent can submit a protest against paternity. Some don't. Some limit the reasons for denying paternity to fraud.

    If he does go to court for a paternity test, I would consult an attorney who can advise whether your local laws would allow him to deny paternity after so much time.
