I married my husband 5 years ago abroad, applied for the visa and got denied because we did not have enough evidence to support that our marriage was real since I did not travel as much to see him because of work and school. After getting denied, my husband came illegally and got arrested, I bailed him out and now he has a deportation case. We have our court date on February 14th to see what the judge decides. We have submitting another application for his visa.

My lawyer has informed me that my husband and I will be needing to get a marriage counselor's affidavit letter which costs $800.00 in order to make our hardship case stronger for the new law of the provisional waiver which will allow for my husband to subsequently obtain his green card.

My question is, how recommended is this counselor's affidavit letter for immigration purposes. Does it actually work or is it just a scam to get money from people like myself that are desperate? Would my case stand a better chance of getting a provisional waiver and allowing my husband to stay in the U.S.A?

It could be both yes and no. Need to get detail info why your case was denied in the first place. If this is the first lawyer you went to, get second opinion.
