    Heir and rights to ashes of father
    I am the eldest,after my father passed away he had left me a life insurance policy. My half brother gave me a lot of grief after the death of my father he took my fathers ashes out of spite, I recectly found my fathers urn is in a veterans cemetery he was place there in 2006, my father passed away in 1998 and myself along with family members had no clue where my dad had been,
    I want to bring my fathers ashes back home and have been in touch with the base and have paperwork to fill out.
    My question is if my dad had no will (which he did't), me being the eldest and was left an insurance policy to me does the make me the legitament heir to my fathers ashes?

    If there is nothing specified on someone's will about ashes, they generally go to the person handling and paying for the funeral or cremation. If your half brother is from a marriage that took place after your mother's, if often happens that the new family gets everything just because the parent doesn't take steps to include his first family. I'm sorry so many years passed with you knowing nothing about it. It happens more and more as there are more multiple marriages.

    The insurance policy has no bearing. However, being the eldest may be the key for you.
