    What are the legal consequences of being evicted in Florida
    I am living in a month to month lease in Florida. I've had a lot of disagreements with my Landlord because he has disrespected my wife and kids (however, that is not the point here). We decided to give him a 15 day notice and look for another place.
    My question is this: He wants me to pay the rent for the time we are staying (15 days) which is fine... But doesn't want to accept to give back my deposit. I asked him to sign a paper that he agrees to release my deposit (minus damages, of course), but he won't sign anything. We are leaving the house in great condition.
    Should I pay him for those 15 days and risk to lose my deposit also? Or, not pay him and let him keep the deposit (as it seems it would be).
    What could happen to me if I don't pay?

    He has to give you your deposit back... minus deductions for damages that excede normal wear and tear and maybe even cleaning if you can't provide reciepts to prove carpet cleaning etc... adn he has to do it within a certain time frame AFTER the unit is vacated and keys returned... you will not get it the day you hand over your keys.

    He was really under no obligation to sign anything you presented him. And as a landlord I would not have either... there are already laws on the books that apply in the situation.

    AS smoothy said, he is required to return your deposit within a statutory time frame or an accounting of what he used it for. If he doesn't then he forfeits the right to keep the deposit and may be liable to damages. On the other hand if you don't pay what you owe, he can apply the deposit towards what you owe and sue for any balance.
