    How do I get my brother to move out
    Five years ago my mother passed away. At that time she lived in a house that my brother and I bought for her. The last few months of her life my younger brother moved in with Mom and hasn't left. We let him live there if he would pay the property taxes, which he did. He now has his girlfriend living there, rent free. This week he informed me that her mother would also be moving in.

    What do I do ? Should I get a lawyer and contact the sheriff to have them all moved out?

    This has been a thorn for the past 5 years and I'm sick of it.

    You told him he could live there if he paid the taxes; he's paying the taxes; but you still want him out? You need to stand by your word.

    You say you and your brother bought the house. Another brother than the one who is living in it, I suppose. Who owns the property, you and your (other) brother, or your mother's estate?

    The first question to answer is: who owns the house? It seems there may be two brothers involved, so please clarify, but I'm guessing that perhaps you and a different brother jointly own the house that your younger brother is living in? If so, then you need to first provide written notice to the tenant that he is to vacate within 30 days. If he fails to do so then you can start the court process for eviction, which may take another 30 days or so before the sheriff actually gets involved. No lawyer needed - just be sure to follow proper eviction procedures for your state and/or town.
