    Help against a neglectful father
    Hi,

    My son who lives in New Hampshire has a 1 year old little boy. He just left his girlfreind and I believe is doing drugs again. When I went to NH on Saturday to see exactly what was going on I realized that he wasn't taking good care of the baby. I got to NH at 4 and the baby was dirty, and he had only fed him food for breakfast and a bottle after that. He was telling me he had no food as if because he didn't have food it was OK or something. I am positive he is back on drugs but not sure what drugs. When his ex girlfriend went to pick the baby up today he was filthy and my son didn't give her anything back. No wipes, diapers, or formula. She had back surgery and is just not getting back to work but it is going to take some time before she gets on her feet.
    What kind of rights does she have? They never married but he is on the birth certificate. I have told her not to let him take the baby if at all possible. I do know that when they broke up he hit her and knocked her out, but she didn't call the police so there isn't a record of it.

    Would you like to clarify your question?
    Generally both father and mother have equal rights.

    What rights does she have to keep her son safe. My son wants to take him for a few days but my son isn't taking good care of him. He isn't feeding him 3 times a day he isn't bathing him and he is doing drugs when he is with him. Can she tell him he can't have the baby? They were never married but he is on the birth certificate.

    She runs the show until he goes to Court and asks for visitation or custody. Has she filed for support?

    Is there any kind of Court Order?

    Let me understand this - the child is unfed, dirty, neglected. How many times have you (and the mother) called Child Protective Services and/or the Police and reported the child abuse?

    But, no, if there is no Court Order she can tell him he can't see the baby.
