    Got a car repo 3 weeks before first payment is due
    Can Someone Help Me Out I Am In California And I Do Not Know My Rights, I Was Supposed To Pay The Registration Fees On The 23 On Feb. 2007 And I Cam In On 28 Of Feb. 2007 To Give Them A Third Of The 412 Dollars I Owed They Said I Could Pay The Rest Of It Along With My First Car Payent On March 28, 2007. Well This Morning March 11, 2007 I Woke Up And Saw My Car Getting Repo'd. What Can I Do About This, They Agrreed And Said It Was Okay Why Are They Still Repo The Car Can They Do This, Even If My First Payment Isn't Due Yet

    Did you call them and ask? What does your contract say? Do you have a written agreement about the delay, any witnesses?

    Whether they can legally repo under the circumstances depends on what the contract says.

    I do not have a written agreement of the verbal agreement. The registration fees on the 1994 ford tempo was 412 dollars. I was to pay 300 dollars on feb 26, 2007 and pay the rest on march 3, 2007 . I came in on feb 28, 2007 and gave them 100 dollars and he said he will add the rest with the first month payment on march 28. 2007. What can I do.

    It is possible that the person ( clerk, secretary, salesperson) that you spoke too lied to you or did not have the authority to do what they said.

    You need to call the car place, talk to the person you talked to and find out what happened.

    If the person was not authorized can I get the car back today. I need my car to get my kids back to school. Can anyone give advice or can you be on the phone on a three-way call and help me talk to them, maybe I need a man voice with me to help talk to them.

    Did you check your contract? That should spell out what rights they have to repo.

    On the contract the fees are included with down payment, however when I went into the dealership he told me verbally that I could pay the balance along with my first car payment due on the 28 of march. He broke the verbal agreement and said that even if he told me it was okay that it was up to the bookkeeper to authorize the repo not up to him. They ripped me off on purpose and I am probably not the only woman they did this too, anyone asking me about this bad place in sacramento ca I will tell them not to go to their business their word can not be trusted. Am so hurt by this. I am a single mother trying to raise two kids alone. This is not fair to me I am a nice person trying to go to college to get my degree. I will forever remember this I won't forget this experience.

    I want you to put on your listening ears. I want you to pay attention. You asked for help. You got some GREAT information. You immediately threw it away, and started arguing... STOP THAT.

    Nobody cares that you're a single mother, certainly not the law. Nobody cares about fair, certainly not the law. Nobody cares that you're a woman. Nobody cares how much you badmouth this place. Nobody cares that you're a nice person. Nobody cares whether you'll remember or not.

    None of that stuff is important (in terms of the law). (Ok, I care that you're nice - but what I think doesn't count!)

    What counts is your written CONTRACT - nothing else! ScottGem has been trying and trying to get you to read it, but you want to argue about something else.

    If you refuse to read it, then take it to a lawyer to read. Or, just lie down for them and remember... I don't know what else to say.

    Yes, you were screwed by this place. And maybe they do try to prey on people with deceptive practices. But that's neither here nor there right now. Right now we need to deal with what you can do. And before we can determine that we need to know what the contract says about their rights to repossess. If there is nothing in the contract that gives them the right to repossess in case of default, then they illegally stole your car. So call the police and report the car stolen. However, if the contract says that they can repo if you default on the terms of the contract, then you have to sue them to get the car back, claiming that you were given a verbal extension. Or you can just pay what you owe (probably plus repo fees) and get the car back.

    Have you asked them what it will take to get the car back?
