    [IRS Notice: CP12] Is it possible to fix Error in your return now?
    Hello,
    I filed 1040NR as my return - I am from PK and hold a F1 visa. I accidentally clicked my status as "Other married nonresident alien" rather than "other single non resident alien" - I have only realized it about 30 minutes ago after seeing this IRS CP12 notice telling me I will receiver far less amount than I have claimed. I am almost freaking out right out now googling to find out if there is any chance to fix the error. All maths on my tax return is based on "Other single non-resident alien".

    Although, I am married and my wife is on F2 but my understanding is I cannot claim myself to be married and claim dependent based on the tax rules of US - Am I correct?

    Please let me know if there is any way of fixing this error. I am thinking to call IRS tomorrow but If you guys have any tips on what should I do please shoot them ASAP!

    I have been in US since Nov 2009 - I am not separated from my spouse. We live together.

    I filed my status as Single in previous year taxation as well.

    Then you filed inaccurately.

    If you are married and are NOT separated from your wife, you must file as a MARRIED non-resident alien and pay taxes using the Married Filing Separately tax tables.

    That is what the IRS did when they re-calculated your tax liability and reduced your refund.

    You should go back and amend your 2009 and 2010 return, pay the extra tax and ask for waiver of the penalties and interest, because, eventually, the IRS will do it for you and THEN there is NO CHANCE of getting the penalties waived.
