Under writ of money judgment. It says:

LEVY ANY AND ALL ACCOUNTS, STANDING IN THE NAME OF THE JUDGMENT OF THE DEBTOR XXXXX, SSN: XXX-XX-XXXX, HELD AT XXXX BANK.

Unfortunately, the judgment is valid. It's with a former landlord that I was unable to pay. However, I've never had an account at the bank cited and I don't really have anything of value that can be taken. No vehicle, no jewelry, art, etc. I'm a widowed mother of two young children. No savings... Do not receive welfare- but I receive a social security payment, and a widow's pension from the V.A..

I owed less than $5,000 but as he's now attached legal fees to that, I owe him just over $5,000. What are my options? What recourse does he have if my assets are non-existent? Are my pensions exempt? Do I need to file for bankruptcy?

Any help is much appreciated.

If you don't have an account there you have no problem with this particular account/bank.

As far as SS and working under the table - first of all, don't ever post anything like that on a public board or, for that matter, repeat that to anyone. I don't want to advise you with knowledge of your fraud.

Second, while SS is exempt other income is not and in many circumstances the Court will not sort out which income remains in the bank, subject to seizure - the SS check or the other money. Do NOT co-mingle funds.

Your widow's pension can be liened to pay this judgment. Again - do NOT co-mingle these funds with your SS benefits.

Thank you, Judy. I've edited my post. So, if the levy is thus far on the wrong track with regard to my bank- should I empty MY bank account? Could I possibly sign over my V.A. checks to my mother to protect that money?
