Generally a spouse is next of kin and would have control of his remains.

We live in south wales and we want them so we can bury him and have closure. His wife is refusing to do this because she doesn't want us to have a.grave to visit.

This is "old" South Wales, in Britain, right? Not to be confused with New South Wales in Australia?

Put up a gravestone somewhere and visit it every week. When she asks you what you are doing, play dumb and tell her "we are visiting Dad's grave, of course." That should throw her for a loop. :)
