    Taxes 1040 and 1040 NR
    Hi ,

    I am Balaji.

    I am F1 student now.

    One of the stupid tax consultant whom I just approached for my tax filing return have filed 1040 on my behalf without my consent. I received 4200 USD as my tax return today. Since I knew that I am not allowed to file as 1040NR, I myself filed 1040 NR on my same SSN a week ago. And that means - IRS will receive 2 returns on my SSN : one for 1040NR (returns I filed by sending courier) and 1040 (Tax consultant did)

    IS there any way that I can come out of this problem ? Please suggest me something.

    And also, I am hired by some company and they have applied for H1 on APril 2,2012. Will there be any impact of this mistake on my H1 processing ?

    Since the tax consultant probably filed the Form 1040 electrnoically, it WILL be your mailed Form 1040NR to the IRS.

    If so, the IRS will reject your second filing once they match SSNs. You will get a rejection notice in the mail.

    Once you do get the rejection notice, file Form 1040X to AMEND the return, and then attach Forms 1040NR (with the word AMENDED printed on the top of the first page of Form 1040NR) and 8843 yto the Form 1040X.
