    L1 A 1040 NR to 1040 & Recovery Rebate eligibility
    Hi

    I have 2 questions -

    I started working in the US on L1 A visa in Dec of 2007. Hence I filed my returns on the 1040 NR form for 2007.

    Question 1 -
    I have worked through 2008 in the US. I assume I can now use the standard 1040 form, as I meet the substantial presence criteria for 2008. I have a wife and 2 kids (as dependants), filing jointly. Please correct me if I am wrong and what I need to be doing instead?

    Question 2-

    Since I filed as Non-Resident alien for 2007, I was not eligible for the stimulus check at that time. Now that I have been a resident for the past whole year, will I be eligible for the Recovery Rebate Credit?

    Your advice will be very much appreciated.

    For 2008 you will file joint return as residents and claim your kids. You will get child tax credit and recovery rebate (stimulus rebate).

    NOTE: The Recovery Rebate Credit is available to you ONLY IF your wife has a SSN. If she has an ITIN, you are NOT eligible for the Recovery Rebate Credit.
