Rights/consequences leaving state with child
I am an unwed mother of a two and a half year old in Idaho. Her father is on the birth certificate and is a convicted felon for possession of narcotics, waiting on a withheld judgement. He has played an active role in her life except when incarcerated for six months. Can I move out of state with her and not be charged with kidnapping? There are no court orders.

Absent any court orders you are free to move. As long as you don't hide from him, you shouldn't be charged with kidnapping.
However, he can file for custody before you can establish residency in a new state and this may force you to return. |
