    Leaving the state with child
    My friend is in a very mentally and emotionally abusive relationship. They have a 16 month old daughter together and live in Vegas. He has taken control of every aspect of her life including finances.

    She wants to leave but has no family around and would need to move to a different state in order to do that. She is scared that her boyfriend will file and win custody and/or make her move back. What are the laws on leaving the states with a young child and what are the chances that he could make her move back.

    Is he the adjudicated father (proven father)? Is he on the birth certificate?

    If not she can move with the child - but he will probably immediately file in Court to try to stop her.

    If so and she is thinking of leaving she should apply for custody and support and request that she be allowed to move.

    Are they married? Is there court acknowledged joint custody of the child?

    The only thing that prevents her from moving is his legal rights in the matter. And we don't know what they are from your note.
