What's Considered Child Abandonment (mi)
My husband & I have joint custody of our son. I spoke to him and we agreed I can go out of state for 8 weeks. To be with my fiancé while he's out of town working. Can he get me for child abandonment? I'm wondering if he's setting me up.. He's just being to nice... I will be in contact with my son daily by phone.

What does the Court Order say? I very recently posted - in NY - about someone who had a written Court Order that she could not move more than X miles. In fact, she moved away double that (2 hours). "Ex" agreed verbally and then filed and she lost custody for ignoring the Court Order, despite the verbal agreement.
Yes, he set her up - or she set herself up because she put her boyfriend ahead of her child. That's, at least, how the Court saw it.
You have a husband AND a fiancé?
And where is this? Michigan Court Order?

EX husband I mispoke. And I'm not moving I would be away 8 weeks. I'm in Michigan. He's even dogsitting for me. I'm wondering if I'm just scaring myself lol

No he can't get you for abandonment. What could happen though is he could file with the court for a change in custody based on your not following the court order on visitation and custody.
So if you think he might be setting you up for this, then get it in writing. Have him sign (possible notarized) an agreement that he will be caring for your son while you are away and that the current custody and visitation will resume when you return.

In NY - and I realize that OP is not in NY - it is "recommended" that the arrangement, including a written arrangement, be ratified by the Court.

Monica, Scott gave you excellent advice, which I am not disputing or questioning. I'm an investigator - I've seen things go wrong.
I would run the arrangement past the Court just to be on the safe side.
Good that you and your "ex" have such a great relationship but, again, I'd really rather know this arrangement is 100% approved by the Court.
