    My family member left belongings behind
    If a person moved out before there eviction date and they did not pay rent since they resided with you
    Do they still have a right to keep the rest of there belongings in your household?

    How long has this been... and how many attempts have you made to get them to remove them so far? Location also helps as laws vary.

    My adult family member and her son has been residing with me since July 2011 and she has not paid any rent to me since they been there she just by food with her foodstamps. I gave her a 30 day notice to be out by March 22, 2012. She moved out on March 4, 2012 but she still have some of her things there. What should I do about the rest of her belongings that are in my house?

    You cannot dispose of her belongings without giving her notice to pick them up. (Technically she is a tenant as long as her belongings are there, but I don't think you want to spend the time and trouble arguing about that.)

    Send her a letter, return receipt requested, and tell her she has 30 days to remove her belongings or you will dispose of them.

    What you do after that depends upon what she does.

    You are going to have to hold onto them for a little while... OR not knowing what state you live in... might be able to move them to a storage facility, you would pay the first months rent and let them know what locker etc its in... so if they don't make the payments or retrieve them then it falls on them for responsibility.

    You might get into trouble if you simple discarded them or donated them, again depending on what state this occurred in without allowing adequate opportunity for them to retrieve their items.

    Did you give her WRITTEN notice or VERBAL notice?

    And please answer what I asked. We actually need the info. We aren't just taking up space.

    I gave her a written notice. One for her eviction date and one for her to come and get the rest of her belongings.
