    Boyfriend left but didn't take belongings
    My bofriend did leave my residence but didn't take his personal belongings (nothing at all) everything is still here. He did take the car we purchased together. What can I do? Do I still have to give him 30 day notice to pick up his stuff. Do I get to keep the car, if I can find it. We were living together for over 8 years.

    Who paid for the car? If he paid half you can't simply keep it even if you find it. Typically you would have to have one person buy the other out of their half based on current value assuming the title is in both names.

    Give him notice in writing, 30 days to arrainge to pick them up. After that move them to a storage facility... in his name... pay the first months rent and send him the key and location. If he doesn't pick them up its his problem... and you are absolved of throwing them away.

    This assumes you have any idea where he is at currently.

    I put the down payment and was making payments for awhile and he's been making payments now.Well he is staying with a friend and I know where he works. So your saying I should write a letter giving him 30 day notice. I can do that.

    Keep a copy and have it sent certified mail... its proof you sent it to him IF he wants to get nasty...

    You are doing this all to cover your own butt legally, NOT to be nice to him...

    You in effect give him 30 days to pick his stuff up... then you move it to storage... it will be in his name... you paid the first months rent.. and if he doesn't pick it up or pay for it then the storage facillity auctions it off. And its out of your hands.

    As far as the car.. if YOUR name is on the loan... then push to get it back or him refinance it to get your name off the loan, Take him to small claims court to get it if you have to because it WILL affect your credit rating and ability to get another loan even if he doesn't go into default and they come after you for it. As long as that loan is valid it appears to be a financial obligation, that you are legally obligated to pay if he fails to. It's the same as you cosigning for the loan.

    Now if his name alone is on the loan and title and not yours... walk away and forget it.

    Like I said.. being nice has nothing to do with it... this is all about covering your own butt if he decides to get nasty about it for some reason.
