    Child Support Verbal Agreement
    For a year and a half, I have had a verbal agreement with the mother of my two kids regarding child support. I get paid bi-weekly, so every paycheck, I give her $350. I have been directly depositing the funds into her checking account and kept the transaction numbers. I want to have some legal backup in case she tries to deny the fact that I provide child support. What kind of consent legal letter can I use to have her confirm our verbal agreement on paper?

    None! Unless a court orders the support they will consider what you have paid a gift. If you refuse to go to court to formalize the support, then ANY letter that states that you are paying and she is receiving the amount as child support. Will have the same effect in court. It may be absolutely none or it may get you credit for the support depending on the mood of the court.

    If you want REAL protection you will get a court to establish paternity, support, custody and visitation.

    Considering the moods of the courts in these times you really need to make it official. You may be paying less by your agreement and then be held liable for the remaining amount in arrears. If that happens it can become a nightmare. So go through the courts and settle it there along with visitation if that is something you would like to have. Without the courts protection you open yourself up to all kinds of trouble.
