    Spouse & I live in different states (FL & GA) - How to file?
    Husband moved to FL & began new job there on Aug. 1. He is renting an Apt there in FL. (He had earned some income in GA prior to move to FL.) Wife still lives & works in GA. There is no State Income tax in FL so no filing there, except Federal of course. Question is how do we file jointly in GA without GA wanting husband to pay income tax on the money he earned while living & working in FL?

    Since your husband is now a Florida resident, you do NOT report the Florida-sourced income on your Georgia return as Georgia income. However, the Florida income IS factored into your income to increase the income tax rate marginally.

    To be more specific - in GA if one spouse is a full year resident and the other a part-year resident you specify filing status "3" (non-resident) on your GA return and complete schedule 3. See page 11 of the instructions:

    For 2012 if your husband is a FL resident for the entire year with no GA-source income then you can file in GA as "married filing separate," even though you probably file a joint federal return.
