Realtor sells our fridge on Craig's List and won't give us the money
As our house sale was closing, our realtor informed us the new owners didn't want our newer upscale, double-door stainless steel fridge. We found a re-seller who would pick up & buy the fridge from us for $150. While a low offer, we know the re-seller and there would be no need for us to try to sell via internet. Our realtor said she could do much better on Craig's List and posted the fridge for sale. We promised to give her $100 commission on a likely $300 sale. She reported she had many interested parties and sold the fridge before new house owners took possession. However, she did not reveal how much she got for the fridge, and thus far, despite several requests, has not given us any money from the sale. I have several emails from her where she notes the money is ours and she's going to send it, but, thus far, 11 days after the sale, no response from her to our latest request.I even agreed to pick up the money. If there any recourse to recovering our money? I figure she must be desperate for the funds, but this is fraud, isn't it?

I'd demand an accounting and "your" money in 10 days and advise her if you don't receive both you are filing in Small Claims Court.

    Send it return receipt requested.

Fraud is a criminal act. I don't know that she defrauded you. She certainly hasn't lived up to the agreement she made with you I don't see any false pretenses.

Normally your "agent" is not the broker for the real estate company. Call and talk to the broker at once. This could cost them their job and actually perhaps their real estate license.
Since she was acting in her capacity as agent, in fact the broker who is over the agency may be held liable also.
