    Any advice? Joint custody is putting my child in an unsafe home.
    I am going through a custody battle and during the trial we have joint custody. My husband is leaving our daughter with a woman who is a known drug user, has had 2 of her children die, and the 1 living child she has cps took him away and she is not to see him. Not to mention his brother has abused everybody in the family for at least 10 yrs and he also leaves her with him unattended. I am trying to work on my case but I don't know what info I should be putting down. Any help would be fantastic. I love my daughter with all my heart which is why I am fighting for custody. He is an OK dad he just isn't keeping her in a safe home.

    How much of this can you PROVE? It would be worth your while to hire an investigator to document that your daughter is being dropped off at this woman's home, keeping track of the hours she is there. The woman's past record is the easy part to prove.

    I have considered hiring an investigator but I do not have the money to do that. Just as I do not have the money to pay for her background check however I will find the money for the background check because I know that will help me greatly.

    I'm an investigator. On occasion I do pro bono (free) work through the local Bar Association. If your child is in danger I'd start contacting investigators and asking for a break.

    Ask the Court to obtain the background check. For that matter, ask the Court to assign an investigator. Do you have an Attorney?

    Yes I do have a lawyer but its almost impossible to get ahold of him

    You are in trial and you can't get ahold of your attorney?

    Or do you mean that you have joint custody until the trial?

    You need to contact your attorney, by doing whatever you need to do, and direct him to file a motion, to be considered on an expedited basis, to change the pretrial custody order. In support of such motion, you will have to submit whatever proof of what you have told us concerning the persons your husband is leaving the child with.
