How long can you get for first time gun charge in Chicago?
My nephew was arrested because the police found a gun in the area, (on the ground), where he was. He has no prior offenses. Could he be facing time even if this gun was not traced back to any prior activity?

We believe the gun belonged to a friend of his.

Unless they can match the gun to him, he should not get any time,

But there is so much lacking in the story, what "area" his home, his bedroom, or on the ground in the park near where he was standing.

Why were the police there, someone robbing someone, someone threatened with a gun, what was going on to make police there.
