    Husband cheated and I am treated like a criminal
    Husband chested all summer. He says its over. He forwarded me emails sent to him and I responded to her mails. I never threatened or anything just told her what I thought of her. Now she had me served a restraining order!
    What rights do I have?

    ;yndajune, if I were you I would ignore the restraining order, I mean unless you are going to go after her which she probably thought you were going to do if your emals were threatening in any way.

    The restraining order will run its time and your rights will not be viiolated and hers will not be either if you keep a cool head. She will go away a lot quicker if you ignore her.

    I am sorry you are in this position.

    Is there a hearing date on the temporary order? You will need to respond to it and appear in court. If you don't appear then your rights can be taken away. You can plead to the judge that you won't do it again and you wish no further contact with this woman. The judge may even modify the order to be mutual. But above all you need to be at the hearing. If they don't show you can ask for it to be dismissed and its over. The laws for restraining orders vary by location so it would help to know where this is taking place at.

    Temporary Restraining Orders are usually entered for a short period, then a hearing is held where the Judge decides to make it a Restraining Order for usually one year.

    Did you threaten her with bodily harm in any way? That would be the only reason she could have obtained this TRO. Show up at the hearing, you will get a Notice of Hearing, and tell the Judge you want it mutual and then if nothing happens in one year it dies a natural death and expires.

    Did you inform her in your emails to her that your husband had forwarded them to you?

    There is a court file on this RO somewhere in the Courthouse records. Have you gone in person to see what her Petition to the Court was for reqesting this RO on you? Have there been any police reports on you over this emailing stuff that contain any kind of violent activity on your part?

    I am very sorry for the situation, but that you are harassing her. Show up to court when you are required to, comply by any of the requirements of the order, and stay away from her. It isn't really fair, but you are going to get yourself in way more trouble if you go after her verbally or physically for what your HUSBAND did to you.
