Your power of attorney expired with her passing. Did she leave a will? Are there any other heirs?

If you have a buyer, the executor of her estate can sell the property unless the property was specifically bequeathed to someone. It does not have to wait for the property to be transferred. Though there may be tax advantages to doing so.

Depends on how backed up the judge is and how diligent the attorney filing the paper work is. Should take less than a week if done right. Anything longer I would be suspicious. Consider short weeks of say a holiday and courthouse closed also.

Like I said, there may be no need to change it to your name to sell it. I would check with your attorney to see if it would be better tax wise to have the estate sell it than have it transferred to you first.

The thing is it could take several months to complete probate and until probate is completed you may not be able to transfer any assets. But you can apply to the probate court to approve the sale. Since you have a lawyer, have you asked them?
