    My daughter sufferd at birth because of my dr
    Hello I have a 2 year old daughter with epilepcy and I don't know if it is due to the problems with her birth or not. Either way I'm looking at getting a lawsuit against my obgyn and this is why...
    January 21st I was in labor and only 7 cm dialated when my dr. told me to start pushing. I started to push as hard as I could and nothing would happen I never even dialated any more then 7 cm. I was pushing for 2 and half hours straight none stop. They just sat there knowing something was wrong and did nothing about it until my daughters heart rate plumited in less then a second. That's when they rushed me to surgery to have a csecion. My pelvic bone was not opening they saind and my daughters head was STUCK in my birth canal from me pushing for so long and so hard leaving her with the whole top of her head one big bruise. I just need to know do I have a case against them for letting me push for that long?

    The only person who can tell you if you have a case is another Physician, an expert, who looks at your chart, your records, your daughter, and then makes a determination of what caused any problems.

    A good Attorney will assist you.

    You NEED expert testimony.

    You will have to get another doctor who will testify in court that the other doctor and hospital made a error.

    You need a Medical Malpractice Attorney, who will look at the records you do have, and who can find you a specialist if he or she is willing to take the case. That way you don't have to pay any money in advance.

    A medical malpractice Attorney in my area would require ALL of the records - that includes hospital records and physicians' records which must be photocopies and charged to the "patient." These are not free bes and can cost (literally) hundreds of dollars.

    The Attorney would then turn the complete history over to a Physician who specializes AND has testified before AND is willing to testify AND is respected in the general field.

    That will cost money.

    Medical malpractice is expensive. I do some of the legwork - and I also don't work free!

    In order to collect someone or more than one must have EITHER done something that should NOT have been done or NOT done something that should have been done. That's malpractice.
