    How much time can you get for fleeing the state when on probation?
    My fiancee' is on misdemeanor probation in chicago. He has been having some problems there to where his life is in danger. His brother was shot and almost died back in January, his 1 year old nephew was shot and died in his arm in march when a drive by shooting accur, this past weekend him and his family was hanging out and some dudes drove up and opened up fire and his cousin was killed. He has talked with his po to get his probation transferred to fl. But she's not willing to let him do that. What right do he have especially if he fears for his life. He wants to flee and get a lawyer to handle his case but he fears going to jail. His probation is up in February 2012.

    First he gets the lawyer. Then the system determines whether he can leave.

    If he violates he can serve the full original sentence OR the full sentence plus time for violating.

    Or maybe Chicago doesn't care enough to bring him back so a warrant will be issued but Chicago won't go and get him. Of course, the warrant never dies so he could be picked up at any time for the rest of his life.

    He has the RIGHT to be transferred. He doesn't NEED his po's permission.. Go here, and read it, and DO it.

    But if he just runs, he can and most likely will get sentenced to jail or prison for the entire sentence, not just what is left. So if he had three years probation, he will serve three years in prison.

    Whether it's a right or a privilege or he's entitled or not - if he just flees he will be violating.

    Sure he can flee but once a warrant is issued for him if he does flee - the warrant never expires and he will be in deep do do whenever he is stopped and this keeps popping up in the computer. Better get with his PO and do it the right way the first time. Sounds like he's had enough problems this year so I don't want to tell him otherwise.
