You go to Family Court when the baby is born. They will order DNA testing before they award support or look at visitation and/or custody.

If you are 15 he can (and possibly will) be arrested for rape (depending on where you are).

You cannot legally give consent to have sex at 15 in MOST places - so it's rape.

You have go to court to obtain child support. Its not automatic. If you need to apply for public assistance, they will probably require that you file for child support and may help you do so.

If the father denies paternity the court will order a paternity test to make sure he is the father.

The age of consent in OH is 16. But unless the father is 18 or older, he would not be subject to prosecution.

I've merged your threads, please don't ASK the same question in multiple forums. If you have any followups, use the Answer options below.

Since the father is under 18, he won't be subject to prosecution for rape based on how I read OHIO law (Section 2907.04).

However, if he is 15, I'm not sure what you expect in the way of child support, at least until he graduates and gets a regular job. You may have to file for a modification when that happens.

The first thing I would do is file for public assistance (assuming you qualify). Like I said, they will probably require you go after him for support and they may provide help. If not, then you go to court as soon as you can after the child is born and file for custody and support. You do not need to and shouldn't ask for a paternity test. He will be served a summons to appear. If he denies paternity, then the court will order a test.

Again, when posting a follow-up question or info, please use the Answer options at the bottom of the page rather than the Comments. It make it easier for us to follow the thread and help you.

Right after your child is born, you will be pretty busy. Will you need and qualify for public assistance?
