I am the father of a son that was born sept.2010. I have had very little contact with the woman. I know that the boy is mine because I was with her during the time of conception and for a few of her dr.'s visits. She lives in a small town in Texas, with her new on-and-off again boyfriend. She won't let me see the baby or get on the birth certificate, which she says she doesn't have. She won't tell me his last name. She has been married before and said she has changed her last name after the divorce was final, so I don't even know her last name now. I live in Missouri. I know for a fact that she is a drug user. She has had 4 previous children before my son with other men,and doesn't have custody of any (1 even taken by CPS) except for my son. She will text me now and then when her and her boyfriend are not together and I have sent clothes, bottles, and other things that he needs. I am also married. My wife and I were separated at the time I met her (I know, it's a mess) but we have rekindled our relationship and are doing great.. just worried about my son. Is it possibly to contact a lawyer here in Missouri to start a paternity test then go from them to try and seek custody? Or do I need to go to the town that where she is? Any advice would be great and my wife is very supportive of the matter. We (my wife and I) also have a son together making my other son his little brother.

You will have to file where the child is a resident. She cannot legally keep you from your son, but YOU have to go to court to enforce your rights. You shouldn't have waited this long.

Unless you have a large law firm in MO with offices in Texas you will need to hire a local attorney in the town in Texas where the child lives.

She can not stop you from seeing the child unless you are a threat and danger to the child. ( and then only the court can stop you) But you have to get visits authorized though the courts. So you file for visits, asking for a paternity test to be ordered by the court.

So you will file and go to court in Texas.

I agree. I shouldn't have wait this long. She didn't tell me when he was born or where they were at. She contacted my grandmother which she said was the only number she remember then got a hold of me in Jan.2011. He was born in Sept.2010. I had be trying to reach her before then but only got her friends who told me she wasn't doing well so when she contacted my grandmother I jumped. I contacted her and she had split with her boyfriend and wanted me to take my son, then she and her boyfriend got back together and she reconsidered. It's hard because I would really love for him to be a part of my family and to know that he's safe.
