    Do I have any rights to my fathers estate and can a sibling DNA test prove paternity?
    My mother had an affair with a man for 3 years of which I am the product of. After she became pregnant they got caught, but no one knew she was pregnant except my father, his brother, and his oldest son. She moved away and I remained a secret for 29 years when I have finally decided to contact them and I was to late. He past away in 2006. They were very rude and told me to stay away becaus:e no one knew in there family and didn't want them to know. I need to know if there is any way to get a DNA test to establish that he is my father so that his name can be put on my birth certificate and do I have any rights to the rather large estate that he left behind?:(

    Yes. Sibling DNA woiuld work, jld, but how would you go about getting something from them to test. They are not going to volunteer this to you if you want part of their father's estate. Unless you can prove you are part of that family, you have no rights whatsoever. I guess you are going to have to be a super sleuth. :rolleyes:

    Tick: I want to hire an attorney to older a paternity test to establish it. I have no father listed on my birth certificate. Can an attorney get such an order, to make my brothers be testd? Thank you. You have been very helpful.

    Even if you are the biological child of the man who passed away, that does not entitle you to anything. If he left a will, he is not obligated to leave you anything. Sad, but true.

    If you succeed in obtaining a DNA test, you then have to fight for what legally was not left to you when your biological father passed away.

    'this' is right jd, if nothing was left to you in the will, you are not entitled to anything. Yes sad. An attorney cannot make anyone relinquish DNA, only a court can in extreme cases, and this isn't one of them.
