Em I going to jail for this? I have not commit a crime or anything.
Im flying to Guam, Northern Marianas Island just to attend my court hearing. Well started this way ,my husband and I fight because that night I wanted to go out with his friend and He said no, so I said why and he siad there is now why. We have a 2 month old in the room with us when the fight started. I was trying to get my son, so I can put him in the another with his sister. At that time my husband thinks that Im going to run aways drunk with my 2 month old son, so he try to grab my son so I can't get him but I try full his feet so I can get him. I wasn't trying to hurt him or anything. All of a sudden my husband gets up and starts slaming me to bed while shoking me, slaping me. I depend myself buy biting him in his thumb so he will stop slaping me, after that happen I was still trying to get my son but voilent started he he push me hard to against the wall and I fight back but I wasn't strong enough. He push me towards the door I put my legs in between the door so he can't close it but he keep pushing the door while my legs stuck. I have bruses all over me. I call 911 but I don't know what happen I end up in jail and not my husband. I was in jail for two days. My husband said that he will never file a case againt me and me either. I want to live happy with my family. Can I bring my 1 year old son in the court because I don't have anybody to watch him.

I don't understand any of your post. If your husband is not filing charges against you, why are you flying (and from where) to Guam, I am assuming you are flying with your young son.

Sorry but what you are trying to explain does not add up to any kind of question or explanation other then 'can you bring your son to court with you'.

You have money to purchase a plane ticket to Guam but you can't pay for a few hours of child care?

Did this fight happen in Guam?

To answer the question, it's up to the judge whether you can bring the baby into the courtroom. My guess is that it will be allowed, but if the baby causes a disturbance the judge will ask you to make other arrangements.

I'm not a legal expert, but I have to ask. If your husband didn't press charges, what's the court hearing for? Who's pressing charges against you? What's the hearing about?

Is your husband also going to court? You don't mention whether he is or not. If not, why can't he look after his child? Not that he'd be my first choice, seeing as he's abusive, but he is the child's father, and you seem determined to stay with him.

My husband told them that his not pressing charges and he wants this stop. This happen last year. Up until now I haven't had any call or message saying that the case is drop. The reason why I have to go to the court is after they release me from jail , they give me release paper stating that I have to attend to the court on 2011. My husband is a military you nevr know what's going to happen. Tight schedule. Evr since that happen we've been staying together
My mistake and can't happen again.

I thank you Ma'm for answering and reading understanding my question

So, this was basically a non issue and you got everyone here upset for nothing. Everyone here are volunteers and try really hard to understand what these questions are all about. I am glad you and your husband are progressing in the right direction, so I gather from your last post.

However, please keep in touch, and try to get some english language lessons, writing and speaking; would help greatly especially if you have children with a military person and having to deal with issues on an english speaking military base.

It strikes me as a typical example of government waste.

They should have resolved this matter before they allowed her to leave the island. Instead, they wait a year, and then fly her half way around the world in order to hold a minor hearing.

Although she starts by saying that she hasn't committed a crime, it looks like that's exactly what she is being charged with. If defense counsel hasn't been assigned, one should be.

Before we got deploy , we went to AG office to ask Question if I can leave off Island and she said as long as I come back for the court hearing then Im fine. If can't show up there at the time of my court hearing then they going to arrest me.I called the local attorney in Guam who has my case to find out what's the status of my case but she said that my case still pending. I don't know what that mean but its almost been a year since that happen and they haven't done anything. I appreciate your answer.

It is similar in the US in a domestic violence case.

The police were called at the time of the fight, the husband or wife does not have to press charges, but the police can arrest and file charges against one or both, they often decide at the scene who they think started the fight.

It sounds like you and husband have made back up and are still together ? Which is great, since if found guility and the child there, it could even be reasons for him to try and get custody of the child.

No I doubt you to to jail, but you may be put on probation, have to pay a fine, and if drinking was involved, go to AA or take a anger management course.

Well, I was the one who call 911 so I can get help from the police but instead I was the one who's injail at that time. If he hadn't hurt me when that happen it wouldn't come this far.
When the police show up they question me who started the fight. I told them him but my mistake by saying to the police the if they handcup him I want to punch him in the face for revenge. That's why probabbly I was the one injail. I nevr went to jail in my life and this is the first one. When that fight happen my son is two month old. He was almost 10 lbs when he was born.no pain med. I have a clean profile. My name is ruin.

My qustion is should I go to jail for saying(if they handcup him I want to punch him in the face for revenge?

You should have kept your mouth shut and only open it to answer questions from the police. (Where they the military police the base?).

By saying what you did it would have been called 'intent to commit harm', so yes you were probably charged on that one. Whatever you did or said while the police were there, did not look good on you obviously.

    Ma'm One more question;

Should I bring an attorney when I show up in my court hearing? And I don't have a job ,I don't have money to pay for the attorney. Do you know where can I get one? Or should I go to local public defender?

    Thank you very much.
