    Should I file my tax return as a non-resident or dual status?
    Hi;

    I worked in US on J-1 visa between July 2008 and July 20, 2010. Now I am back in my home country. I filed with Form 1040 NR for 2008 and 2009 tax returns. Could anyone give me some info on how I should file for 2010?

    Should I file as a non-resident or dual status?

    Is filing as dual status any different than filing as a resident? I thought both used the same form 1040?

    File dual status tax return.
    Yes, dual status is different from filing resident return. You will use Form 1040 for period up to July 2010 and Form 1040NR or 1040NR-EZ for period after July 2010.

    Hi MuKata;
    Thanks for your reply. But I am a little confused.
    1-I think the pub 519 says I need to file Form 1040 NR and attach Form 1040 as a statement? Is that correct? Does that mean I cannot claim my wife and daughter as my dependents again?
    2-I did not have any income related to US after July 2010 do I need to write the earnings from my home country (I pay tax for those in here)?
    3-If I am required to file with 1040NR am I entitled for a refund of medicare and social security taxes?
